1. Acceptance of Terms

By accessing or using VidRab ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

VidRab reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Service Description

VidRab is an automated TikTok story video generation platform that uses AI technology (Claude AI and ElevenLabs) to create short-form video content for users. The Service includes:

• AI-generated story scripts across multiple genres
• Professional AI voiceover narration
• Automatically synced subtitles
• Background video footage
• Ready-to-upload TikTok videos in 1080x1920 format

3. Subscription Plans & Pricing

3.1 Available Plans

VidRab offers three subscription tiers:

• Starter: $49/month - 30 videos per month
• Pro: $99/month - 60 videos per month
• God Tier: $199/month - 100 videos per month

3.2 Billing

All subscriptions are billed monthly in advance. Payment is processed through our payment partner Paddle. By subscribing, you authorize us to charge your payment method each billing cycle.

3.3 Video Quota

Video quotas reset on the 1st day of each calendar month. Unused videos do not roll over to the next month. You may not exceed your monthly video limit.

3.4 Price Changes

We reserve the right to change pricing at any time. Existing subscribers will be notified 30 days in advance of any price changes and will have the option to cancel before the new pricing takes effect.

4. User Accounts

4.1 Account Creation

You must create an account to use VidRab. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Acceptable Use Policy

5.1 Permitted Use

You may use generated videos for:

• Posting on TikTok and other social media platforms
• Personal or commercial content creation
• Building your social media presence
• Generating passive income through content monetization

5.2 Prohibited Use

You may NOT use VidRab to:

• Generate content that violates TikTok's Community Guidelines
• Create illegal, harmful, threatening, abusive, or hateful content
• Generate content that infringes on third-party intellectual property rights
• Resell or redistribute generated videos as a service to others
• Reverse engineer, decompile, or attempt to extract the source code
• Use automated tools to abuse the Service or generate excessive requests
• Share account credentials with multiple users

6. Intellectual Property

6.1 Ownership of Generated Content

You own the videos generated through VidRab for your account. Once generated, you have full rights to use, modify, and distribute the videos as you see fit, subject to the Acceptable Use Policy.

6.2 VidRab Platform

VidRab retains all rights, title, and interest in the Service itself, including all software, algorithms, designs, and technology used to provide the Service.

6.3 Third-Party Content

Background videos and music used in generated content are licensed for use in the Service. You are responsible for ensuring compliance with platform-specific terms (e.g., TikTok) when posting content.

7. Refund Policy

7.1 Digital Goods - No Refunds After Use

VidRab generates custom, unique AI videos for each user. Once videos are generated, they cannot be "returned" as they are personalized digital content created specifically for your account.

This is similar to purchasing custom artwork or eating a meal at a restaurant — once the service is performed or product is delivered and used, it cannot be returned.

7.2 7-Day Money-Back Guarantee (Pre-Generation)

Full refund available if you have NOT generated any videos:

• Available within 7 days of initial subscription
• Only if you have NOT generated any videos on your account
• Request via email: [email protected]
• Refund processed within 5-7 business days
• First-time subscribers only

7.3 Post-Generation - All Sales Final

Once you generate your first video, all sales become final and non-refundable. By clicking "Generate Videos," you acknowledge that:

• Custom digital content is being created for you
• AI resources (Claude API credits, ElevenLabs voice generation, server time) are being consumed
• Videos are unique and cannot be reused for other customers
• The purchase is non-refundable once service is performed

7.4 Subscription Renewals

Monthly subscription renewals (2nd month, 3rd month, etc.) are non-refundable under all circumstances. The 7-day guarantee applies ONLY to your initial first-time subscription.

7.5 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will NOT receive refunds for:

• Unused time in your billing period
• Unused video quota
• Partial months of service

7.6 EU Consumer Rights (Article 16(m))

For EU customers: By generating videos, you expressly consent to immediate performance of the service and acknowledge that you lose your 14-day right of withdrawal as provided under EU Consumer Rights Directive Article 16(m).

You retain the 7-day money-back guarantee if you have NOT generated any videos, providing consumer protection while respecting the nature of custom digital content.

8. Service Limitations & Availability

8.1 Service Availability

While we strive for 99% uptime, we do not guarantee uninterrupted access to the Service. Scheduled maintenance and unforeseen technical issues may cause temporary service disruptions.

8.2 Generation Time

Video generation typically takes 78 seconds per video but may vary based on server load and technical factors. We do not guarantee specific generation times.

8.3 Video Quality

While we use advanced AI technology, generated content quality may vary. We do not guarantee that all generated videos will meet your specific expectations or go viral on social media.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDRAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• Generated videos will be free from errors or technical issues
• Content will comply with all third-party platform requirements
• Videos will achieve specific engagement or monetization results
• The Service will meet your specific business needs

11. Indemnification

You agree to indemnify and hold harmless VidRab, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you generate and post using the Service

12. Privacy & Data Protection

Your use of VidRab is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VidRab operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration rather than in court, except where prohibited by law.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use after such changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and VidRab regarding the Service.
